A trademark is a type of intellectual property that is typically a name, word, phrase, logo, symbol, design, image, or a combination of these elements. Trademarks identify the goods of one manufacturer from the goods of others. As such they are extremely valuable business assets. The overall intent of trademark law is to prevent consumer confusion about the origin of a product. Trademark infringement occurs when one company uses a trademark that is so similar (or identical) to the registered mark of the owner that it is likely to deceive or to cause confusion on the part of the average purchaser.

The best way to determine whether or not infringement has occurred is to conduct a scientific survey of potential customers to determine whether or not the infringer's mark is causing confusion.
